§15Meetings and Rulesamended

Current text
Journal. The Council shall cause a journal of its proceedings to be kept. Upon the request of any of its members the ayes and nays upon any question before it shall be taken and a record of the vote entered in the journal.
Proposed text
Record. A record of Council meetings must be kept in a manner prescribed by the Council rules and the laws of the state of Oregon.
§23f§23(f) Interference in Administrationamended

Neither the Mayor nor any member of the Council shall in any manner, directly or indirectly, by suggestion or otherwise, attempt to influence or coerce the Manager in the making of any appointment or removal of any officer or employee or in the purchase of supplies; or attempt to exact any promise relative to any appointment from any candidate for Manager, or discuss, directly or indirectly, with the Manager the matter of specific appointments to any City office or employment. A violation of the foregoing provisions of this section shall forfeit the office of the offender. Nothing in this section shall be construed, however, as prohibiting the Council, while in open session, from discussing with or suggesting to the Manager, fully and freely, anything pertaining to the City affairs or the interests of the City.
Proposed text
In order to protect the fundamental form of government chosen by the voters, guard the power of the council as a body, defend against corruption, ensure transparency, and preserve the separation of authority set forth in this Charter between the manager’s administrative authority and the council’s general powers, no council member may actually coerce or attempt to coerce the manager or a candidate for the office of manager in the appointment or removal of any city employee, or in administrative decisions regarding city property or contracts. A violation of this prohibition is grounds for removal from office by a majority of the council after a public hearing. This prohibition does not apply in publicly noticed meetings, including but not limited to council or committee meetings, executive sessions, and work sessions.

§26Applicability of State Lawsamended

Except as the same may be inconsistent with the provisions of this Charter, all the laws of this State regulating and governing elections and proceedings and matters incidental or relating thereto or connected therewith shall apply to and govern elections under this Charter.

City elections must conform to state law except as this Charter or ordinances provide otherwise. All elections for City offices must be nonpartisan.
§29Nominationsamended
Current text
Effective January 1, 1955, all elective officers of the City of Corvallis shall be elected on a nonpartisan ballot. The Council shall provide by ordinance for the nominating of elective officers by petition, which shall be the sole and exclusive method of nominating such elective officers.
Proposed text
The Council must adopt an ordinance prescribing the manner for a person to be nominated to run for mayor or a city councilor position.
§41Special Assessmentsamended
The procedure for levying, collecting and enforcing the payment of special assessments for public improvements or other services to be charged against real property willshall be governed by ordinance.
§43Existing Ordinancesamended

Remove Redundancy, Not Rights.

Removes Charter provisions that duplicate existing state law, are elsewhere in the Charter, or are better done in ordinances, without eliminating a single voter right or protection. Public meetings, initiative rights, referendum rights, and Charter amendment rules all remain fully intact. A cleaner Charter is a stronger one.

§18Meetings to Be Publicremoved
All deliberations and proceedings of the Council shall be public, except as provided by State law.
Why removed: Covered word-for-word by ORS 192.630 (Oregon Public Meetings Law), which already requires all meetings of any city governing body to be open to the public. Oregon’s law is more comprehensive — it defines exceptions, notice requirements, executive session rules, and enforcement. The charter sentence adds nothing.
§25General Electionsremoved
A general municipal election shall be held biennially in the City of Corvallis at the same time that the general biennial election for State and county officers is held in the State of Oregon, and at each general election the successors shall be elected for all elective offices whose terms of office expire prior to the next biennial election.
Why removed: ORS Chapter 254 (Conduct of Elections) governs when and how city general elections are held. Specifically, ORS 254.035 already requires city elections to coincide with the state biennial general election. The charter provision restates what state law already mandates.
§27Qualifications of Electorsremoved
No person shall vote at any City election unless the person is a qualified elector of the State of Oregon and a resident of the City.
Why removed: Voter eligibility is set by Oregon Constitution Article II, §2 and implemented through ORS 247.009, which states that a person may vote in a city election only if they are a registered elector of the city. The charter cannot define voter qualifications differently from state law, so this provision is both redundant and legally powerless.
§28Special Electionsremoved
The Council shall have the power to call special elections. A special election shall be called by ordinance setting forth the purpose for which such special election shall be called and the proposition(s) to be voted on the day on which such election shall be held.
Why removed: The authority and procedure for calling special elections is governed by ORS 221.230.
§30Notice of Electionsremoved
The City Recorder shall give notice of all general or special elections by publication thereof in the City official newspaper once a week for two successive and consecutive weeks, within 30 days next preceding such election. Such notice shall state the officers to be elected, and/or measures to be voted upon as herein provided and, in case of a special election, the place designated for holding such election and the time thereof. Any error not affecting the substantial rights of voters shall not invalidate any election.
Why removed: Election notice is governed by ORS 254.095, which requires the city elections officer to file statements of offices, candidates, and measures with the county clerk no later than 61 days before the election. The county then handles public notice under state law. The charter’s “official newspaper” requirement is outdated and more restrictive than state law requires.
§31Canvass of Election Resultsremoved
To canvass the results, the City Recorder shall call to the Recorder’s assistance two qualified electors of the City, not of the same political party, and they three shall then canvass the returns of the election. A written statement of the canvass shall be made and signed by the canvassers, or a majority of them, and filed with the City Recorder. Such writing must contain a statement of the whole number of the votes cast at such election and the number given for any person for any office and the name of the persons elected and to what office and also the number of votes for or against any measure submitted to the people.
Why removed: Canvassing of election results is governed by ORS 254.565, which assigns this duty to the city elections officer (not a panel of local electors). The Benton County Elections Division conducts the canvass in practice. The charter’s procedure — requiring two local electors from different parties — conflicts with how state law actually works.
§32Initiative and Referendumremoved
Initiative petitions shall be signed by a number of legal voters equal to 15 percent of the votes cast for Mayor at the last preceding municipal election. Referendum petitions shall be signed by a number of legal voters equal to 10 percent of the votes cast for Mayor at the last regular preceding municipal election.
Why removed: Requirements and thresholds are determined in State Law. The Corvallis Municipal Code sets requirements within State Law and is up-to-date; Requirements set in the Charter are not current. Best practice is to use the Municipal Code to stay current.
§42Public Improvement Contractsremoved
All public improvement contracts shall be subject to the limitations of State law.
Why removed: This section simply says city contracts must follow state law — which is already true by definition, with or without this sentence. ORS Chapter 279C (Public Contracting — Public Improvements and Related Contracts) comprehensively governs competitive bidding, prevailing wages, and all other requirements for public improvement contracts. The Charter provision is redundant.
§48Amendmentsremoved
An amendment to the Charter of the City of Corvallis, or new or supplemental Charter, may be proposed and submitted to the legal voters of the City by resolution of the Council. No amendment of the Charter shall be effective until it is approved by a majority of the votes cast thereon by the legal voters of the City. The ballot title of such amendment shall be the same as prepared and submitted with such amendment, or new or supplemental Charter, by the resolution of the Council.
Why removed: The process for amending a home-rule charter is established directly by Oregon Constitution Article XI, §2, which grants city voters the power to enact and amend charters. Charter amendments must go to voters regardless of what §48 says. Removing this section does not change how amendments work — the constitutional requirement stands on its own.

§5Construction of the Charteramended

The Charter shall be liberally construed to the end that the City may have all powers necessary or convenient for the conduct of its municipal affairs, including all powers that cities may assume pursuant to the laws and to the municipal home-rule provisions of the constitution of the State of Oregon.
Proposed text
The Charter will be liberally construed so that the City may exercise fully all powers possible under this Charter and under United States and Oregon law. The specific mention of particular powers in the Charter shall not be construed as limiting in any way the general power granted in this Section. This Charter’s interpretation shall be examined in its entirety. In this Charter no mention of a particular power, right, privilege, or immunity shall be construed to be exclusive or to restrict the scope of the powers, rights, privileges, or immunities which the City would have if the particular power was not mentioned.
§6Exercise of Powersamended
All rights, powers, privileges, and immunities of the City shall be exercised in the manner prescribed in this Charter, or, if the manner be not prescribed in this Charter, then in the manner provided by ordinance or resolution of the Council or the laws of the State of Oregon. Distribution. The Oregon Constitution reserves initiative and referendum powers as to all municipal legislation to City voters. This Charter vests all other City powers in the Council except as the Charter otherwise provides. The Council has legislative, administrative, and quasi-judicial authority. The Council exercises legislative authority by ordinance, administrative authority by resolution, and quasi-judicial authority by order. The Council may not delegate its authority to adopt ordinances.
§35Enacting Clause → Legislative Authority (Ordinances)amended

The enacting clause of all ordinances hereafter enacted by the Council shall be: "The City of Corvallis ordains as follows:"
Proposed text
(a) General. The Council will exercise its legislative authority by adopting ordinances. The enacting clause for all ordinances must state "The City of Corvallis ordains as follows:" (b) Ordinance Adoption. 1. Except as authorized by subsection (2), adoption of an ordinance requires approval by a majority of the Council at two meetings. 2. The Council may adopt an ordinance at a single meeting by the unanimous approval of at least a quorum of the Council, provided the proposed ordinance is available in writing to the public at least one week before the meeting. 3. Any substantive amendment to a proposed ordinance must be read aloud or made available in writing to the public before the Council adopts the ordinance at that meeting. 4. After the adoption of an ordinance, the vote of each member must be entered into the Council minutes. 5. After adoption of an ordinance, the City Recorder must endorse it with the date of adoption and the Recorder’s name and title.
§36Ordinance Passage → Administrative Authority (Resolutions)amended

The procedure for passing ordinances shall be such as the Council by ordinance determines. Upon passage, the Recorder shall endorse it with the date of its passage and the Recorder’s name and title of office, and within three days thereafter the Mayor shall sign it with the date, the Mayor’s name, and the title of the office, unless the Mayor vetoes or does not return such ordinance as provided in Section 22.

An ordinance enacted by the Council shall take effect on the tenth day after its enactment. When the Council deems it advisable, however, an ordinance may provide a later time for it to take effect, and, in case of an emergency, it may take effect immediately.

§14Qualifications for Officeamended

Qualifications. No person is eligible to fill an elective office of the City unless the person is a qualified elector of the City and unless the person has resided in the City one year immediately preceding any election at which the person is a candidate. Conflicts of interest. Conflicts of interest are prohibited. All officers of the City are subject to the strictures, limitations and penalties of all applicable laws.

(a) The Mayor and each Councilor must be a qualified elector under state law and reside within the city for at least one year immediately before election or appointment to office. (b) No person may be a candidate at a single election for more than one City office. (c) Neither the Mayor nor a Councilor may be employed by the City. (d) The Council is the final judge of the election and qualifications of its members.
§16Quorumamended
Current text
A majority of the members of the Council shall constitute a quorum for it to do business, but a smaller number may meet and compel the attendance of absent members in a manner provided by ordinance.
Proposed text
Except as specifically addressed here and in Section 34, a majority of the Council members is a quorum to conduct business. In the event of an absence, a smaller number may meet and compel attendance of absent members as prescribed by Council rules. In the event of a vacancy due to resignation or other events, the quorum is reduced accordingly solely for the purpose to make necessary appointment(s) to reach the required quorum as outlined in Section 34.
§21Vote Requiredamended
Current text
Except as this Charter otherwise provides, the concurrence of a majority of the members of the Council present at a Council meeting shall be necessary to decide any question before the Council.
Proposed text
The express approval of a majority of a quorum of the Council is necessary for any Council decision, except when this Charter provides otherwise. The voting requirement to fill Council member vacancies, if there is less than a majority of council members remaining, is separate from the quorum requirement required to conduct all remaining City business unless otherwise stated.

§34Filling Vacanciesamended

A mayor or councilor vacancy shall be filled by appointment by a majority of the remaining Council members. The appointee’s term of office runs from appointment until expiration of the term of office of the last person elected to that office. If a disability prevents a Council member from attending Council meetings or a member is absent from the city, a majority of the Council may appoint a councilor pro tem.

Notwithstanding the quorum requirement set forth in Section 16, if at any time Council membership is reduced to less than five, the remaining members may, by majority action, appoint additional members to raise the membership to five. As little as a single Council member may constitute a majority for purposes of filling vacant Council seat(s) if all other Council seats are vacant, and the Mayor may vote and constitute a majority for purposes of filling vacant Council seats if all Council seats are vacant. a) The City Council must fill vacant positions on the City Council by appointment. Any ordinance establishing a process to fill vacant City Council positions must: 1. Fill any vacant position no later than 60 days after the vacancy is declared. 2. Invite nominations from the ward with the vacant position. 3. Interview nominees and hold a public hearing prior to the Council voting to make any appointment. b) If there is a vacancy in the office of Mayor which occurs 120 or more days prior to the first day of the new term, the vacancy must be filled by a City-wide special election within 60 days when possible, or at the next scheduled State election date thereafter. Should a vacancy occur leaving fewer than 120 days remaining in the term, the candidate who receives the most votes for that office in the regular election will assume office immediately upon validation of the vote.

Charter Review Task Force

These seven individuals unanimously recommended all four measures after months of careful study. The full City Council unanimously referred them to voters.
